Terms and Conditions

1. The Customer as detailed in section “B” hereby acknowledges and confirms that
this Design Information Brief has been prepared and completed based on
information and specifications provided by the customer and its agents and
accordingly the customer and its agents shall be liable for any error or
misdescription contained herein.

2. The Customer was advised to make whatever investigations and to obtain
appropriate expert advice before completing the Design Information Brief.

3. The Customer acknowledges and warrants that the information and specifications
contained in this Design Information Brief are true and correct in every respect.

4. The Customer hereby acknowledges and confirms that except to the extent
permitted by law, Netafim Australia Pty Ltd ACN 056 229 755 and its associated
entities, its directors and staff will not be liable nor responsible for any loss or
damage suffered by the customer of whatsoever nature kind including but not
limited loss or damage to or arising out of crop failure, damage to land and
buildings and for consequential loss and damage arising from, caused by or
contributed to by the adoption, use or implementation of the information and
specifications contained in this Design Information Brief.

5. The Customer acknowledges that Netafim Australia Pty Ltd and its associated
entities and agents will rely on the information and specifications contained in
this Design Information Brief to provide advice to the customer, prepare reports,
manufacture and/or acquire goods and/or carry out certain works.

6. The Customer also indemnifies Netafim Australia Pty Ltd, its officers, servants
and agents against all claims, losses, demands, proceedings, awards or
judgements suffered incurred or brought or made against Netafim Australia Pty
Ltd and its officers, agents and servants as a result of or contributed by the
adoption or implementation of the information and specifications contained in
this Design Information Brief.

7. The Customer hereby acknowledges and confirms that the Design Information
Brief is in relation to the land situated at the address provided in section “C” and it
relates to the crop types provided in section “A”.
